Terms of Service

These Terms of Service ("Terms") govern your access to and use of SightVia (the "Service"), operated by EXD Lab Pte. Ltd. (UEN: 201733062K), a company registered in Singapore ("SightVia", "we", "us"). By accessing or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of a school or organization, you represent that you have authority to bind that organization.

1. The Service

SightVia is a survey and reporting platform that lets organizations build forms and surveys, collect responses, and generate branded PDF reports. Some surveys may require respondents to authenticate using Google Sign-In, restricted to a domain configured by the organization running the survey.

2. Accounts

  • You must provide accurate information when creating an account and keep your credentials confidential.
  • You are responsible for all activity that occurs under your account.
  • Notify us promptly at [legal@sightvia.com] if you suspect unauthorized use of your account.

3. Customer Organization responsibilities

If you administer SightVia on behalf of a school or organization (a "Customer Organization"), you are responsible for:

  • Ensuring you have a lawful basis, including any required consent from parents/guardians for respondents who are minors, before collecting personal data through a survey
  • The accuracy, appropriateness, and content of surveys you create
  • Managing which staff and members have access to your organization's data within SightVia
  • Complying with the Personal Data Protection Act 2012 and any sector-specific guidance (e.g. Ministry of Education policies) applicable to your use of the Service

4. Acceptable use

You agree not to:

  • Use the Service to collect personal data unlawfully or without appropriate consent
  • Upload malicious code, attempt to gain unauthorized access, or interfere with the Service's operation or other users' use of it
  • Use the Service to harass, defame, or discriminate against any individual
  • Reverse engineer or resell the Service without our written consent

5. Data ownership

As between you and SightVia, your organization retains ownership of the survey questions, responses, and reports it creates ("Customer Data"). We process Customer Data solely to provide the Service, as described in our Privacy Policy, and do not use it to train third-party models or for advertising.

6. Third-party services

The Service relies on third-party infrastructure and providers, including Supabase (database, authentication, storage), Amazon Web Services (application hosting, email queueing), Resend (transactional email), and Google (OAuth sign-in). Your use of Google Sign-In is also subject to Google's own terms and privacy policy.

7. Intellectual property

SightVia and its licensors retain all rights, title, and interest in the Service itself (software, design, branding), excluding Customer Data. We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

8. Suspension and termination

We may suspend or terminate access to the Service if you breach these Terms, misuse the Service, or if required by law. You may stop using the Service at any time; upon termination of a Customer Organization's subscription, we will handle Customer Data retention/deletion as described in our Privacy Policy.

9. Disclaimers

The Service is provided "as is" without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or fully secure.

10. Limitation of liability

To the maximum extent permitted by law, SightVia and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising from your use of the Service.

11. Governing law

These Terms are governed by the laws of Singapore, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Singapore.

12. Changes to these Terms

We may update these Terms from time to time. We will post the updated version on this page with a revised "Last updated" date, and where changes are material, we will provide additional notice.
